Terms & Conditions
1. Introduction
1.1 These terms and conditions govern the sale and purchase of products through our website.
1.2 You will be required to give your express agreement to these terms and conditions before placing an order on our website.
1.3 Nothing in this document affects your statutory rights as a consumer, including rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
2. Interpretation
2.1 In these terms and conditions:
(a) “we”, “us” and “our” refer to John Farrer & Co. (Kendal) Ltd;
(b) “you” and “your” refer to the customer or prospective customer.
3. Order Process
3.1 The advertising of products on our website constitutes an invitation to treat and not a contractual offer.
3.2 No contract shall come into force unless and until we accept your order.
3.3 To place an order, you must add products to your basket, proceed to checkout, provide the required details, confirm your acceptance of these terms, and complete payment.
3.4 Once payment is processed, we will send an order acknowledgement. A binding contract is formed only when we send an order confirmation.
3.5 You will have the opportunity to identify and correct any input errors prior to placing your order.
4. Products
4.1 Products available may include coffee, tea, brewing equipment and related accessories.
4.2 We reserve the right to modify or discontinue products at any time without liability.
5. Prices
5.1 Prices are shown on our website.
5.2 Prices may change at any time but will not affect confirmed orders.
5.3 Prices are shown exclusive of VAT unless stated otherwise.
5.4 Delivery charges will be displayed before checkout.
6. Payments
6.1 Payment must be made in full at checkout.
6.2 Payments are processed via our chosen payment service provider.
6.3 Failure to pay may result in order cancellation.
6.4 Unjustified chargebacks may result in liability for all associated costs incurred by us.
7. Deliveries
7.1 Delivery arrangements are detailed in our Delivery Policy.
8. Subscriptions
8.1 Some products are offered on a subscription basis and involve repeat deliveries at a selected frequency.
8.2 By purchasing a subscription, you enter into a recurring contract governed by these terms and any subscription terms shown at checkout.
8.3 Subscriptions that include a discount are subject to a minimum commitment of two (2) orders.
8.4 The first order is charged immediately at checkout. The second order is charged automatically at the next scheduled billing date.
8.5 Subscriptions cannot be cancelled before the minimum commitment has been fulfilled, except where required by law or where the product is faulty or incorrect.
8.6 Once the minimum commitment has been met, subscriptions may be cancelled or amended at any time before the next billing date.
8.7 Cancelling a subscription does not entitle you to a refund for any order already processed or dispatched.
9. Distance Contracts – Right to Cancel (Cooling-Off Period)
9.1 This section applies only to one-off, non-subscription purchases made by consumers.
9.2 You have the right to cancel such orders within 14 days of receiving the goods, without giving any reason.
9.3 To exercise this right, you must notify us clearly before the cancellation period expires.
9.4 Returned goods must be sent back within 14 days of notification, and you are responsible for return postage.
9.5 Refunds will include the cost of standard delivery (excluding premium delivery options).
9.6 Refunds will be issued within 14 days of receiving the returned goods or proof of return.
9.7 This cancellation right does not apply to:
(a) subscription orders subject to a minimum commitment;
(b) food, drink or perishable goods once dispatched;
(c) goods that have been opened or unsealed.
10. Warranties
10.1 We warrant that products will be of satisfactory quality, fit for purpose and as described.
10.2 If a product is faulty or incorrect, you are entitled to a refund, replacement or repair in accordance with your statutory rights.
11. Liability
11.1 Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.
11.2 We are not liable for indirect or consequential losses or business losses.
12. Order Cancellation by Us
12.1 We may cancel an order if payment is not received or if you breach these terms.
12.2 We may also cancel orders due to events beyond our reasonable control.
13. Consequences of Cancellation
13.1 Upon cancellation, obligations to deliver undelivered products cease.
13.2 Payment obligations for delivered products remain enforceable.
13.3 Certain clauses will survive termination where legally required.
14. Scope
14.1 These terms do not transfer or license intellectual property rights.
15. Variation
15.1 We may update these terms by publishing a revised version on our website.
15.2 Updated terms apply only to orders placed after publication.
16. Assignment
16.1 We may assign our rights and obligations provided this does not reduce consumer protections.
16.2 You may not assign your rights without our consent.
17. No Waiver
17.1 No waiver of any breach shall constitute a waiver of any subsequent breach.
18. Severability
18.1 If any provision is found unenforceable, the remaining provisions remain valid.
19. Third Party Rights
19.1 These terms do not confer rights on third parties.
20. Entire Agreement
20.1 These terms, together with our Delivery and Returns Policies, constitute the entire agreement.
21. Law and Jurisdiction
21.1 These terms are governed by English law.
21.2 Disputes are subject to the non-exclusive jurisdiction of the courts of England.
22. Statutory & Regulatory Disclosures
22.1 These terms are provided in English only.
22.2 We recommend saving a copy for your records.
